How Much Detail Can The Police Obtain From Your Mobile?

The police are getting a warrant to check on my phone billing records as my number was called by a mobile phone that was left at the scene of an armed robbery last week. I;m a criminal solicitor and get lots and lots of calls from unusual mobile numbers everry day as I;ve always given my mobile no out. I told the CID today I couldn;t recall who called me at a certain time and date 10 days ago which is the truth.

In my job I see mobile phone records for the likes of drug offences where texts have been sent involving drug supply.

My question is how detailed can the police check your phone?

I assume that no calls are recorded by the phone companies just numbers, duration and time and date of calls in and out. Without having possession of my phone what text message details can they get, can they get message content for sent and received messages?

all they can check is the times calls and text were made/sent and recieved. plus the phone holders details if its been registered!

my phone is not registered in my name and they haven;t asked work whos phone it is but I;ve suspected my phone has been bugged for a while so its no surprise they had my name and address next to my number
 
i think they can still get all info off your phone even if its been deleted, like text messages. ive sat in quite a few trials in crown courts and its pretty amazing how much info they can get off them. They wont know whats been discussed in conversations but if you think your phone has been bugged then they'll already know. All they will want your phone for is to check through your phone records and if some of the numbers match up between yours and the found phone then you could be linked to the crime. if not then you'll be forgoten about. hope this helps and makes sense

I know they can get deleted texts off a seized handset but they are not seeking to seize the handset they are just going from records. I agree about how amazing it is and worrying what they can get from your phone. Why an armed robber would take one with him I;ll never know.

Theres nothing discussed on my phone anyway as I meet my clients they are a very suspicious bunch but my worry is my phone gives the offender away as that could result in difficulties for me doing this job in this area.

I;m not going to be linked to the crime so thats not a worry its just it could give the identity of the offender away

the only reason they will be looking at yours is to try and link you to it somehow, like if you were in regular contact with that phone or if a few numbers match up between the 2 phones.
Id have thought that if they couldnt get prints off the found phone or if its not registered then they are clutching at straws and they'll be checking alot more numbers off the found one.
As far as giving the identity away goes then thats a long shot, even if they were found from something on your phone then it'll come out in court and it will be said that they siezed your phone and thats how they found it out, not that your a grass which i presume your worrying about.
 
its going to be the only connection cos there won;t be prints and none of my regulars register phones.

not the grass bit but would be awkward if I was the cause of their capture

I can't stand when people with hold information because "they're not a grass" I'd prefer to have drug dealers etc off the street so I can walk through Birkenhead without the fear of being stabbed by a dirty needle all for the measly £2 for the bus fare home after being ripped off at the Vue cinema.

Anyway, you live in upton right? You're not that far from the police station then at upton roundabout. I notice a few people can be let out after a night in the cells and then go collect their free money from the job centre next door.

Edit: What exactly do you do as a criminal solicitor? Are you one of those guys who are provided if you do not have your own solicitor? Keeping drunk drivers on the roads etc for procedural errors? Getting drug dealers off with 20 minutes community service? (Not a personal dig at all if it is, just I think the punishments for certain crimes aren't sufficient. Also I'm quite interested in what your job entails)

My girlfriend was complaining that the helicopter had hovered and circled directly over her house for about 30 minutes.
 
If you didn't do anything wrong you've got nothing to worry. Though on the moral ground if you do know something about it though I do believe you, I think you should report it.

I can;t have the moral ground cos I cannot give up information that my clients give me, its confidentialand privelaged so I can;t just offer that information. Nothing to do with being "a grass". My job is to defend people and like a doctor I have to preserve confidentiality. The only time I;m under a duty to report anything is if a client says they are going to seriously harm someone.

If I did report this I;d be struck off as a solicitor and probably prosecuted myself!my concern is that this could affect my career which pays to feed my wife and kids .

Theres no people in the cells at Upton just in the wirral custody suite in the lovely north end so the people you see coming out will be the police lol

Lol, I was exaggerating the point of 20 minutes etc. I have two close family friends in the Police. One is pretty high up in the Merseyside police (he usually seems to deal with homicides or prostitutes from what I'm told haha) but whenever I talk to him and I talk to him about hows it going etc. He usually has something to say about the sentencing given. That plus our friendly program Street Wars and Road Wars... doesn't make it look good!

That's kinda funny I found out purely by chance, perhaps you have something to do with the robbery of the spar in thingwall last night? The helicopter was hovering over my girlfriends house for a good 30 minutes. She lives right round the corner from the ATM which got smashed.

I get very annoyed though at those caught possessing illegal drugs and then being let off with crap. I know someone personally who got caught for possession of cocaine on the street and he got £80 fine. **** is with that? It was personal use but its still highly illegal. My neighbour got caught for drunk driving but because his wife threw a hissy fit and the police fell for it, it took them nearly an hour to get him back to the station and then he literally scraped through on the station breathalyser. < Cheeses me off seriously even he knew he was ****ed but because of the drama the police went to calm it down (his wife is very loud). I was watching it unfold out my window as well, he got pulled over just as he was turning onto his drive. I have the belief that a drug dealer was living next door to me in Irby as well... some very suspicious characters hanging around at the top of the street one would come down knock on the door walk back and walk of with his group of mates.

Speeding is something that ticks me off seriously around here as well. Some ****ing idiots on the roads, especially on that road up to birkenhead from A.park hospital. Then again we got the meatheads who sit around mcdonalds on the night time zooming off like idiots too don't know which is worse though speeders or those who drive up your ****.

I completely respect your position as well on your job and did not mean to make a personal jab at you. I understand what you mean though.

What's the most interesting or bizarre case you have had? Assuming you can tell us this after a case has been to court.

Also if you've got nothing to hide is it possible for you to bypass the whole issue of them having to get a warrant and just provide them with the details? Or is it one of those they must have it anyway?
 
They can find anything they want out ;) but it seems like in this case they are just checking you out so you have nothing to worry about.

There was quite a serious robbery and shooting the other day where two very expensive cars were stolen just so that they could do it...
 
If this is a serious worry, why aren't you consulting a lawyer, instead of a fish forum? Besides all of us just kind of guessing, the laws in your country, state, region, and city are going to be different than the laws in the county, state, region, and city of almost any other member.

So, if this is really a concern, retain the services of a good local lawyer and go from there.

Simon is a lawyer. a solicitor specialising in criminal law :D I am quite sure he was not relying on info from us, but it was interesting to hear about anyway.

If this is a serious worry, why aren't you consulting a lawyer, instead of a fish forum? Besides all of us just kind of guessing, the laws in your country, state, region, and city are going to be different than the laws in the county, state, region, and city of almost any other member.

So, if this is really a concern, retain the services of a good local lawyer and go from there.

I am a criminal local lawyer with lots of experience but I;m not a telecoms expert hence my enquiry with a worldwide forum.
I;m not worried about anything dodgy, a bit annoyed that all my personal texts will be displayed for the lod police to view who I all know

I am a criminal local lawyer with lots of experience so its not laws I;m enquiring about its what the police can obtain from my phone. I;m not a telecoms expert hence my enquiry with a worldwide fish forum where there are people from all occupations and knowledge who could enlighten me
