HELP Please. Need Advise/opinions

I won a beautiful pair of fish (the red/platinum) I begged everyone not to
bid on a couple days ago. OK, here is the problem. The seller Just Emailed me saying that the male is clampy, and she is treating him. She was sorry, and isn't charging me. I would really like to breed this pair. I asked if she would send the rest of my order, then when they were well, send the other pair. Seller responded,
saying that, it would not be possible. She is moving, and in a time crunch. To me that sounds like she is giving up on this fish. DOESN'T IT? Otherwise why not just ship the pair at a later date? I asked if she was giving up on Spike. (They were advertised as A Spikey pair of Ct's, So I'm calling him spike) I understand she may just not have the time to take care of him, since she is in the process of moving. I sugested that if she is giving up on him, that she just ship him in meds. to me. He will get to me in less than 24 hrs, and I'll try to nurse him back to health.


WHAT DO YOU THINK? IS THIS A GOOD SOLUTION?
ANY OTHER SUGESTIONS?

SHE ISN'T SHIPPING UNTIL MON, OR TUES ANYWAY. IF SHE HAS BEEN TREATING HIM SINCE LAST NIGHT (SAT), SHOULDN"T HE BE BETTER, OR DEAD BY THEN?

I hope there's some kind of feedback place you can go to and rip her a new one.

That was COMPLETELY uncalled for.
OOoooooh that makes me angry.

Come to think of it, that has to be a breach in your buyer/seller agreement.
I'd look into that, for the sake of the fish that died unnecessarily.

I would go after her full bore and wouldn't stop until she was sorry she messed with me.
But that's just me. :*)
 
That is awful, I am sorry to hear that. I can't believe she would kill a fish because she didn't want to treat it. That is how it sounds anyway. Are you still getting other fish from her? Did you pay for the fish before she "culled" it?

What does the term "culled" mean anyways? Sounds like a word to try and cover up for her horrible and uncalled for actions.
 
Awww, I'm so sorry to hear that! That was one beautiful fish. I can understand it from the seller's point of view too, though. Too many fish, too little time. Still, I wish they would have at least waited to see if you would have been interested in it even though it was ill :sad:
 
I would have at least been willing to take it sick for free, and give him a chace. Or even pay, then get money back if he died. The worst part is that because I won that pair, and It was going to be $24.50 shipping no matter how many I won, I bid/won 5 more auctions. Total was over $100.

BettaMomma, I was thinking the same thing. It does say that by bidding, you are entering into a legally binding contract. In my opinion; even if I have not paid yet, once I bid, and the auction ends, that fish is mine. So, if that is true; she killed MY fish, not her own. She should have at least asked my opinion, before killing him. I don't know if that is legal though.
 
This is wrong in so many ways. I believe by killing your fish she's broken any contract, and I would tell her she can keep all her fish. Then I'd post about it in your feedback section.

I don't think that what she did is in any way against Ebay regulations. The item isn't technically yours until it is bought and paid for. Once the fish got sick, he was no longer the item you bid on (a healthy fish,) so she did right by offering it for free, and she's also being very generous, I think, by offering a free pair. Depending on how sick he was, her actions very well might have been the best thing for him. Shipping is very stressful for the fish and I doubt she would have culled him if she had thought he could have made it through that alive.
