oh fishlette, you poor chook, you must be raging!!!!
i agree with the others, get the wages you are owed, and kick her a*#e with a great new shop. Let me know when and where you open, and i will transfer all my custom to you. Furthermore, as i know the name and location of the old shop, i will let some of my friends know the broad outline of what has happened, and steer them towards your new venture.
If you have stock that you can't use now, and need to turn some over before you open up again, have you considered trading on-line? And do you want me to start shopping from your stock now? or wait till you are set up again? Am always (more often than i should, anyway) buying tanks, filters and lights, as well as the everlasting conditioner and food........
all the best, and remember to keep your focus on your goal.
merry.

Crikey. There's no love lost in business and that is what contracts are for. There is no room for 'nice' people any more. Expect to be shafted by your suppliers, your customers, your country (taxation etc) and your staff - always prepare yourself for the worst!

I know it's a terrible thing to have to say, but I think you know that you may have been a little naive in being so trusting - so look on the positive as this being an excellent (but all be it expenisve) lesson. I used to be like you - 'nice' to my employer & think that it would actually get me somewhere: I'd work all the hours God gave me, not getting a SINGLE penny in overtime - was I ever thanked? - hell no. Was free overtime then the 'norm'? Hell yes. Did they whine, whinge, complain & dig when I stopped doing free friggin overtime? Hell yes. Did that stop me from telling them to sod off? HELL NO!

You have been utterly shafted and I hope you can learn from that - unfortunately don't trust ANYONE. Get EVERYTHING in writing: Don't assume anything will happen & don't lift a finger until it is. I hope you did not buy stock for that shop (using your money) using a P.O. raised by the shop, otherwise it could be seen that the stock you took home (because after all, you paid for it) is not actually yours in the eyes of the law! If she has liquidated the business then kiss goodbye to your wages - you'll be far down on the liquidators list for repayment. If it is still solvent, sue for earnings (I hope to hell you have at least got an employement contract) and do it NOW before the company does go bust. You have nothing to loose and everything to gain by doing this.

I really feel for you and I just really really hope that your shop becomes a swimming success (pardon the pun). Put your anger to one side, take a deep breath and move on - if you are, being angry will burn you out. Just ignore her (just think how completely annoying it is to be ignored by someone when trying to win an argument) and move on to bigger and better things. :good:

wow! thanks guys. you've given me a lot to think about with regards to how i can go about getting at least my wages. id like to reply to each person but it makes me dizzy thinking about it :)

i paid for the stock by forfeiting a few weeks pay originally. that few weeks just seemed to keep going though.

and yeah, im not angry anymore. im annoyed still but im already moving on :) got bigger and better things ahead :good:

That's the way to do it fishlette!
So many people would've just given up on their dream after something like that happening to them.
It's so great to see that you haven't and are pushing forward!

there is nothing i know of that can stop you handing out your leaflets over the road from her shop advertising your business!!

I would have thought you would have a case worth pursuing too, though I have no knowledge of Australian law particularly.

Good luck with the new shop!

I'm interested in an update on your situation...have you managed to resolve anything?
