Seriously tho, I am going to tell him what I did, . He doesn't bother with it anyways, says he lost interest in it so he will prolly be glad.

I'd ask or offer first.  Also after you have got it safely, you could offer it up for re-homing to a bigger tank in the classifieds on the board.
