So basically long story short, I can't afford the last term of my contract at my Accommodation. And I can't borrow the money from anyone as no one else has it. If I can't pay, what will happen?, anyone with legal expertise in this know, would be much appreciated. (It's student accommodation). I've been actively looking for a person to take over my contract for 4 months, but no one is biting.

I'm from UK, so I don't know if different laws apply to the US.

Thanks
Ace

I can tell you what would happen here (u.s) but as you've stated the laws might be different.

Ace sorry to hear this budd, i dont know about it myself, but look out for simonas, hes a lawyer, may know abit more than most, good luck with it Ace :good:

The only thing I'm annoyed about is that it'll take away from what I can do next year, this was my first year out and I greatly underestimated how much it would cost to feed myself, and I also fell sick so I was traveling home a lot. Ah well, learn from my mistakes I guess?

Sesshis, you could, there might be some similarity, maybe. Thanks.

Is there not someone at the Uni that you can talk to? Not been to Uni myself but surely there are student advisers and the like. If not try the Citizens Advice Bureau they should be able to help.

id advise talking to your landlord, some are very forgiving, i know ours is, and also talk to a housing officer at your uni, and maybe citizens advice. citizens advice may also offer you legal aid should you need it :)

The Uni will help you out Ace (thats if you've been a good student). I have attended 2 uni's and both have been really good when it comes to this kind of stuff. I was lucky that i have my house now, but Lincoln Uni would have offered up digs at a stupidly low price. I'm sure your Uni will help you out.

Get in the Uni digs! :good:

Yeah isnt life so different when you flown the nest, bills at every corner,

When you say the last term, is this a month or more? i mean i rent my flat out, the lad got messed about by his work company, he asked if he could wave a month, them make it up over the next few, which i agreed and he did, he did some over time to cover the extra, then they paid him a month after<work eh>

Have you sat down with your parents and exspained the situation, maybe they could bail you out, then you have the freedom to pay them, this way it does not effect your good repore with the landlord, maybe next time you will to ask for a reference for another property,

Also as stated find out where your local citizens advice bureau is, they are there to help you mate. :good:

oh ps...have you signed a contract? check in there to see how much notice you have to give?

What absolute #######s, I phoned them up, they didn't try to help at all, they just said you're going to court. I thought student companies were meant to help, the company is called Unite Student Living.

■Misunderstandings and disputes are reduced.
■Where problems do occur they are promptly resolved.

Tell them theyve said this and that taking you to court is not a quick solution.

Go to CAB, they're really good for people in times of need!

It's not like I haven't tried to get someone to replace it, I have been for 4 months. I actually got someone, and we was signing the contract and they was trying to charge him for months I had already paid for, and they wouldn't even refund me the money that I had paid for (I would have gladly given this to the guy) so he would of taken the contract. It just seems like they're trying to squeeze as much money as they can out of everybody no matter who they stamp on. If you look at their prices next year they've upped it from £170 to £192 for a shorter contract, because of the Olympics I'm guessing so they can make money out of that. But are still charging the same amount, so £8500 for 40 weeks instead of 8500£ for 51 weeks, pure scam company.

Hmm sounds fustrating, have you spoken with simonas, maybe he can help abit, if not find a local solicitor in your area, some offer a hours free advice, if you want first mind, id reccomend speaking with citizens advice :good:

Ace, how much do you actually owe if you don't mind me asking? The chances are they're just using court as a threat, dragging a case through the civil courts is hideously expensive and time consuming for them if they lose.

Idk...I think they have to go to court, legally. Here you have to go through a whole process of steps to evict someone from an apartment(if you're not then I'm sorry, thought you were speaking of apts).

But basically you can't pay so you miss a months rent. They notify you with a letter saying you are pasted due and now have a late fee

If you don't respond in a couple weeks they will send you another notice, and I think they may have to send a 3rd one?

After that you get the eviction notice saying pay up or you will be thrown out. I believe they have to give you a couple of weeks to a month and then a court date is set and you are notified to appear at court.

Theoretically if you show up and pay the full amount, they can't do jack. You get to stay. If you miss the date or don't pay? Thats when they tell you to get your stuff out or they go in and throw everything away if you don't.

Thats how it was explained to me. One of my roommates wasn't paying and I was wondering how long it would take them to kick her out, she was a horrible roommate :grr: . I'm not exactly positive about the time limits, but I think its a couple weeks to a month. I'm not a lawyer and contacting one in your area would be a good idea. Or like others have suggested getting a loan from parents, bank, etc. Do you have a job? can you ask them for an advance maybe? I'm sorry you're in this situation  I really hope it all works out for you
