this was delivered to my 71 year old grandmothers house as i am at work 7-5 so cannot take delivery myself. the listing says

Owing to the delicate nature of this item, it must be checked immediately on delivery and any damage must be notified AT ONCE otherwise claims for damage will not be accepted.

whats the legality on that? will ebay stand by that or do i have the higher ground? if it comes to it and i filed a claim with the small claims court what r my chances of winning? im seriously naffed off with this the item was packed really badly and its over £400 worth of light

thoughts please people :-(

Thats crap

If I were you, I'd phone the ebayer straight away and report the damage.
If they have an e-mail address, sent them the photos too.

I carn't help you with the legality side of things, but what I've mentioned is a good start :good:

Just say the postman wouldn't wait while you opened it, it was broke on delivery.

It should be postal insured, the sender has to claim though.

ive sent him the pictures already its just so bloody annoying im sitting fire here!

Did you pay to insure it. I'm sure if you contacted ebay they'd correct this,

Have you made contact with the seller explaining the situation?
It's very common for people to send packages to someone else to sign and accept and then collect later that evening.
Any reasonable seller would understand and honour this.

ok the seller has replied with this

Hi. I am very sorry to hear that. These units are usually very good but I suppose there is a first time for everything! Can I arrange to have another one sent out to you tomorrow and have that one collected at the same time? I have been selling these on and off now for 18 months and apart from the odd smashed plug I have not had any problems with them so it is unlikely that a second one would also be damaged. Let me know what you think. My apologies again, Diane.

its good to know there are still honest sellers out there im happy now :) thank you everyone for your help :D

I would have been so pissed of if I got that broken like you did. Luckily you got someone who is professional. Hopefully the next one comes in one piece.

Well at least he was willing to work with you. I know a few who not even be willing to work with the buyer, the seller just wants the money!

ya , many ebay sellers are great... one time i won a bid and then later i didnt want it so i asked the seller if it was alright for me if i dont buy this item and he said ya its cool and another time i bought aN ITEM and then i didnt want it so he refunded my money....always ask the seller 1st cuz most of the time they r forgiving...and always read between the lines about wat the seller will be willing to do b4 commiting to buy something :good: a friendly advice
