Hemigrammus rodwayi?
If it's a tetra, it probably was not getting along with others because it was kept on its own or with too few others of its own kind. Get it into a nice shoal of 10-15+, and it should behave quite well.

Thanks it's quite active at the min to say he's been inteoduced with some bosses of the tank an nobody has bothed it yet so a trip to lfs to get some more lol, would a smaller school be ok as this is quite big about 2an half "

I consider 6 to be an absolute minimum for any shoal or school, and I personally prefer to not keep fish in groups of under 10 if they're schooling. Also, it's probably worth keeping in mind that H. rodwayi reportedly live for only 3-5 years, so if he's already an old fish…
Have you gotten a positive ID on your fish? Does he have white-tipped dorsal and anal fins? And the black spot on the caudal, with a bit of red top and bottom of it?
