Look what our back yard forest let us see!

So I was outside wateeing some of our plants and fertilizing them... And then I saw this:
At first I didn't know what type (non venomous or venomous) but then after some closer looks at him/her I concluded it was non-venomous and was hanging around him for a while. I took a few amazing pictures on my camera but my phone takes cruddy ones so, sorry bout that lol.

Could be, but ive seen those before and their black black... Here is a pic of one from about a year ago that was a friendly guy:
The one that you see in the most recent picture I took is brown with black markings all over him.

I live on the east coast but I live about 45 minutes from the ocean.... I'm at a state near Virginia (I dont wanna give my exact state)
