Does anyone know why my dwarf gourami is occasionally sitting next to the heater? (even when it's not on)

It might have more to do with that leaf overhead than the heater. That said, what temp is your tank?
 
Looks like he's building a bubble nest under that leaf
 
Not unexpected, he could just be inexperienced with building it, or he's not happy with the turnout and removes it to start over

okay another question one of my black neon tetras has a bent spine that I just realized today but it didn't have it when i got it

Get a photo, as best you can.

Is it looking skinny or is it just bent? There's a couple causes it could be, from injury, to illness, to malnutrition, to even parasites, or even a complex of reasons.

Not much to go off of there, keep watch for string white poops in case it's parasites. Sometimes they can take nutrients from the fish's musculoskeletal system and cause bends, but those usually happen in chronic cases. But still, it's something to watch for.

I am currently treating ich right now if that would have an effect?
 
No, it don't think bent spines is a side effect of either ich nor medication
