a question out of interest:

is a common pond newt purely aquatic or does it need to have access to some form of land
 
All newt species even the purely aquatic like to have a small amount of land to lay on at times. Easiest way if you don't want to section off a side of the tank, make a floating island.
 
You can buy islands/caves too at the pet store, but if your water is very deep they may not stick out of the water enough. Newts also like to rest on aquatic plants floating just under the water's surface.
 
i had a japanese firebelly newt that loved to kick it on my magnefloat. it was perfect size for him.

Pretty important to note that there is no such thing as a common pond newt, and it is illegal to interfere with our native amphibians, so don't bother unless you know what your doing to begin with.

What you have in the pond is probably the smooth newt.

Yep I agree. Its probably a smooth or palmate newt and should not be kept in captivity. Besides the fact its illegal they have quite specific needs as they spend the spring/early summer fully aquatic and summer/autumn on land.
